1. In case a retail buyer detects some technical flaws while using the product or concludes that the product does not conform to the agreement, the buyer may exercise their warranty rights and conduct the complaint procedures via BlackSword.pl. In that case, the buyer must log in on their account and enter the ‘RAISE A COMPLAINT’ panel.
After
entering and filling out the form, the complaint notice must be printed and
signed and put into the parcel together with the product which the customer
wishes to complain about. After packing, an address label with RMA number must
be printed. The label must be glued to a visible place on the parcel with the
product which the customer wishes to complain about.
We will not accept any parcels on postal collection order, or parcels that have no visible label with RMA number.
2. A retail buyer may exercise their warranty rights only after producing:
a. a filled out warranty card (serial no., type, purchase date – same as the date on receipt, seller’s seal and buyer’s signature),
b. a valid receipt,
c. the flawed product – in case of airsoft guns, with the warranty seal intact;
d. RMA complaint form with a detailed description of the flaw or defect.
3. Any complaint on damage incurred while transporting or on any products missing in the parcel will only be considered with a complaint report issued upon the acceptance of order, together with the employee of Poczta Polska post or shipping company.
4. Warranty includes all product flaws caused by flawed spare parts or production defects.
5. Warranty repairs do not include maintenance and inspection of the products, especially cleaning, adjustment, operation control, operating errors correction or other actions that lay within the responsibility of the user.
6. Warranty provides free spare parts and labourage for retail buyer, according to the terms and conditions specified in the warranty, within 1 year, 6 or 3 months from the date of purchase, depending on product category:
a. new airsoft guns – 1 year warranty
b. gas-powered airsoft guns – 6 months warranty
c. spring airsoft guns – 6 months warranty
d. other accessories and spare parts – 3 months warranty.
7. While exercising the retail buyer’s warranty rights, the buyer is obliged to deliver original packaging, warranty card and purchase confirmation together with the product, as well as a detailed description of the flaws and their circumstances (on the RMA form), plus all the accessories that the packaging contained at the moment of purchase. The cost of sending the product to service will be covered by the customer, while the cost of sending the product back to the customer in case the complaint is deemed justified will be covered by the shop.
In
case there is an unjustified complaint or the product is damaged by the
customer, all costs of return transport and service work will be covered by the
customer.
8. Any defect reported within the warranty period stated in art. 6 will be looked into by the Service within 14 working days. The period starts from the next working day after the product has been delivered to the Service. The defect will be removed within 14 days from considering the complaint. The time for removing the defect may be prolonged, should there be a need to import the necessary spare parts. In that case the customer will be immediately informed of the fact.
9. If only a part of the product is flawed and it can be detached from the working part of the product, the customer’s warranty rights are only limited to the flawed part of the product.
10. The retail buyer is entitled to exchange the product for a new one through the Service, if:
a. during the warranty period, stated in art. 6, the Service performs five warranty repairs and the product will still display flaws that prevent its proper usage.
b. The Service fails to perform its duties, stated in art. 9,
c. The Service will provide a written statement that removing the flaw is impossible.
11. If circumstances do not allow to exchange the product for a new one (e.g. the product is not offered anymore), BlackSword.pl shop will exchange the product for a different one with similar technical parameters. Such action will be deemed as fulfilling the warranty provider’s duties.
12. The Service will exchange the product for a new one within a period of time agreed with the buyer, not longer than 21 days from reporting one of the premises stated in art. 11. The period starts from the first working day after the buyer has claimed the exchange of full flawed product (including accessories and packaging). While exchanging the product, the shop will deduct the amount payable for any missing or damaged parts that the buyer is liable for.
The
claim for the exchange of a product must be submitted within 7 working days
from the day the customer was informed of the premises stated in art. 11.
13. Warranty does not include: mechanical damage, defects caused by improper usage, maintenance or operation. Also, the warranty does not include parts subject to natural wear, such as:
a. mags;
b. contact blocks;
c. engine brushes;
d. Hop Up rubber;
e. valves and gaskets;
f. batteries and charges included with the product;
14. BlackSword.pl reserves the right to exclude from warranty all genuine decommissioned military products.
15. The manufacturer and/or Owner of BlackSword.pl are not liable due to this agreement (warranty service) if the necessary repairs cannot be performed because of import/export restrictions for spare parts or due to other legal regulations or unforeseen circumstances that prevent performing any repair or the results of force majeure.
16. All flawed products or parts which have been exchanged within warranty become property of the Service.
17. The manufacturer and/or Owner of BlackSword.pl are not liable to the buyer for loss, damage or destruction of the product for reasons other than those lying in the nature of the product itself. They will not be liable for any damage resulting from the flaws of the product.
18. Warranty rights do not include the buyer’s rights to claim indemnity for lost profits due to product malfunction.
19. According to Consumer Rights Protection and Hazardous Product Damage Liability Act dated 02.03.2003 (Book of Acts 2000, no.22, item 271) the buyer is entitled to withdraw from the purchase agreement within 10 days from product delivery. If the product is returned, the buyer is obliged to inform the seller of their intent to withdraw from the purchase agreement by e-mail to kontakt@blacksword.pl. The returned product must be complete, must not bear any traces of usage and must include the original manufacturer’s packaging intact. The returned product must be accompanied by the original receipt and a filled out and signed product return form. The cost of product return is covered by the buyer. The buyer is obliged to secure the product properly so that is does not become damage during transport. Should the returned product be incomplete or bear any traces of usage, BlackSword.pl reserves the right to refuse to accept the parcel or to reduce the refunded amount. After receiving and accepting the product, BlackSword.pl will refund the amount to the buyer, issue a correction invoice and send it back to the buyer’s address. After receiving the correction invoice, the buyer is obliged to sign its copy and send the copy back to BlackSword.pl address.
20. The warranty for our products is not transitive.
21. The above provisions on warranty apply to RETAIL CUSTOMERS.
