Terms and regulations of BlackSword.pl shop

General provisions.

1. The domain BlackSword, with its internet address at http://www.blacksword.pl, known as the shop, enables viewing the product range and declaring the will to purchase the chosen product.

BlackSword shop is owned by X-SERVICE Sebastian Czerwik seated in Wroclaw at ul. Kwiska 102, registered in company register of the President of Wroclaw, company number 168960, Tax number 899-181-95-08, REGON: 932982438.

2. Using the BlackSword domain involves accepting these terms and regulations.

3. Each registered customer is obliged to give actual contact information, including address, e-mail and telephone number for the purpose of delivery of products and contacting BlackSword staff. The information is made available to shipping companies that deliver the products.

4. The contents of BlackSword.pl do not constitute an offer as stated in the Civil Code. The products listed on the website are for presentation purposes only. Placing an order does not involve immediate conclusion of an agreement. When completing the order form, the customer submits an offer to purchase a product. The product ordered by the customer may differ from the one shown in the picture on the website.

5. All prices are set in polish PLN and include VAT.

6. The price stated given to each product prevails until it is out of stock.

7. The shop reserves the right to alter the prices of products offered, to introduce new products to the range of products and to implement and cancel promotion campaigns on the shop website or alter them.

8. The seller will make every effort to make all products available on BlackSword.pl shop website correspond to current stock of the Seller. In case a product or its parts on order are unavailable, the Seller will immediately notify the buyer of the fact and, if the buyer has already made payments for the said product, the Seller will refund the total amount paid by the buyer.

9. In case there is a promotion or sale for a limited number of products, delivery will be effected  according to the sequence of confirmed orders for the said products, until they are out of stock.

Orders

1. The online shop BlackSword.pl is open Monday to Friday, 8 a.m. to 6 p.m., excluding public holidays. In case there is a non-statutory holiday, the shop will present proper information on the website in advance.

2. All orders are accepted on http://www.BlackSword.pl. After accepting an order, an e-mail will be sent to the given e-mail address, asking to confirm the order. The shop will not complete orders which are not confirmed.

3. Orders will be completed within a period of up to 4 working days from the moment the order has been placed and all contact information given (parcel sent shipping company).

4. The customer who places an order in BlackSword shop undertakes to pay for the ordered product and the delivery and to accept the parcel delivered to them. All costs resulting from not accepting the parcel will be incurred by the customer.

5. All ordered products are delivered via Poczta Polska post and DPD shipping company. DELIVERY COST

6. Delivery date of the ordered product is subject to the operation of shipping company. BlackSword shop will make every effort to help deliver to parcel as soon as possible and in prefect condition, however BlackSword shop is not liable for any possible delay or damage to the parcel.

7. The terms and regulations of the shop apply to parcels delivered within the territory of Republic of Poland. Terms and conditions for delivery of products to other countries are set separately.

8. The shop reserves the right to refuse to complete an order or to require the production of certain documents or making a pre-payment before carrying out an order. Such a decision will not require any justification on the part of the shop staff.

9. Payment for the ordered products may be effected by money transfer to bank account prior to product dispatch (pre-payment) or in cash to the courier/at the post office upon acceptance of the parcel (postal collection order).

Final provisions

1.   The BlackSword.pl shop is not liable for orders placed by third parties who use the login and password of the customer.

2.   The names of products in Blacksword.pl shop are used for identification purposes only and may be registered trademarks of their respective owners.

3.   The shop is not liable for orders which were not completed due to product being out of stock for reasons beyond shop’s control.

4.   The shop reserves to right to make possible mistakes in the description of products, including price.

5.   Placing an order in BlackSword.pl online shop also means that the customer agrees for personal data included in the order to be stored and processed by X-SERVICE Sebastian Czerwik, according to legal regulations currently in force – Personal Data Protection Act dated 29.08.1997 (Book of Acts 2002 No. 101, item 926 w/ alterations).

6.   BlackSword.pl hereby states, that the buyer’s personal data will only be processed in order to confirm and accept an order effectively and to deliver the product to the address given by the buyer. The buyer has the right to view their personal data stored by BlackSword.pl, to alter them or delete them from the system.

7.   In case any dispute arises from the purchase agreement, they will be looked into by the respective court of the defendant or the respective court of the location where the said agreement has been concluded.

8.   Any cases not addressed by this agreement are subject to the provisions of Civil Code and Consumer Rights Protection And Hazardous Product Damage Liability Act dated 02.03.2000.

9.   According to Article 8 paragraph 3 item 2 point b) of Internet Services Act dated July 18^th, 2002, the customer is forbidden to post illegal comments or contents on BlackSword.pl website.
